General terms and conditions for the provision of sport halls by the USC

  1. Definitions

USC: Trade name of the Stichting Universitair Sport Centrum, the operator of sports facilities of the University of Amsterdam and Amsterdam University of Applied Sciences.
User: The natural or legal person who uses a space in one of the USC sports facilities and has entered into a user agreement with USC for that purpose.
User agreement: The agreement in which the concrete arrangements regarding the use of space by the user in one of USC’s sports facilities are recorded.
Quotation: The document in which concrete price agreements and hours of use of space(s) in one of USC’s sports facilities are recorded. A quote accepted by the user is considered by the user and USC as a usage agreement.
Sports facility: The accommodation in which the sports hall is located.
Sports hall: A space specified in the quotation, or a part thereof, in one of the USC sports facilities, consisting of one or more sports floors and associated areas, such as locker rooms, showers and toilets.

  1. Realization of user agreement

The user can reserve a sports hall with USC’s Zaalreservering Department. If USC accepts the reservation, USC offers the user a quotation. Once the offer is confirmed and accepted in writing, it is considered a user agreement.
An online booking also constitutes a user agreement.
The user agreement is subject to the general terms and conditions as well as the house rules.
If necessary, USC will impose special conditions of use to be determined in more detail.

  1. User fee and payment.

The user shall pay the user fee due in the manner described in the quotation.
USC may, in appropriate cases, charge the user as an advance payment a percentage, to be determined by USC, of the charges set forth on the quotation. If cancellation of the event by the user occurs within the 28-day period set forth in Section 5 of these Terms and Conditions prior to the start of the event, the deposit shall be forfeited to USC.
The sports hall cannot be put into use by user until USC is in possession of an offer accepted by user.
By taking into use a hall belonging to a series of reservations, the user accepts the corresponding quotation. USC will then proceed to send the corresponding invoice.
For one-time use of a hall, the user fee must be paid prior to the event. The user fee, if applicable, includes VAT.
Amounts less than €100.00 must be paid at the front desk of the sports facility.
USC reserves the right to terminate a user agreement if the user does not meet the payment obligation. If, after a payment reminder, the user has not remitted the user fee due within the period specified in the payment reminder, USC will take collection measures. All costs associated with collection shall be borne entirely by the user.

  1. Services USC

USC undertakes to provide a safe and clean gymnasium, including the use of sports equipment, changing rooms, sanitary facilities, showers, lockers, and music system (if standard in the hall).
Under conditions specified in the user agreement, USC may provide various paid additional services, including:
Preparing, installing and putting away equipment and materials not included in the user fee.
Staffing before and after the regular opening/closing time of the sports facility, sports instructors, first aid personnel, security.

  1. Cancellation

If the user cancels the use of the sports hall provided to him on the dates and times specified in the offer, the user is obliged to notify USC in writing.
If, from the date the user agreement is established, up to 28 days before the date in question, the reservation is cancelled, USC will charge 25% of the charges stipulated on the offer.
If, within a period of 28 to 14 days prior to the date in question, a reservation is cancelled, USC will charge 50% of the cost established on the quotation.
If a reservation is cancelled within a period of 14 days prior to the date in question, USC will charge 100% of the fee established on the quote.
Additional cancellation conditions may be included in a user agreement.
In case of cancellation of an online reservation, no refund will be made.

  1. Condition at start of use and after end of use

The user must notify USC of any complaint about the condition of the sports hall they are using immediately upon discovery and confirm to USC in writing within three working days. If the user fails to do so, the hall is deemed to have been in good condition.
The user shall return the gymnasium swept clean after use.
If the user does not leave the hall in good condition, damaged or soiled, USC will perform that in which the user has remained negligent. USC will recover the costs thereof from the user.

  1. Use

The user is not entitled to give the sports hall placed at their disposal to third parties for use.
The user undertakes to use the space placed at their disposal only for sports activities or other activities stipulated in the user agreement.
The hours stipulated in the offer apply to the use of the sports hall. The associated changing rooms and showers can be used before and after the hours stipulated in the user agreement.
The user cannot enter the room provided to them outside the hours stipulated in the user agreement.
The preparation of the room by the user must take place within the hours stipulated in the user agreement.
Assuring the cleanliness of the sports hall must take place within the hours specified in the user agreement.
Only sports shoes with non-slip soles may be used in a sports hall.
It is prohibited to play sports on a sports floor with sports shoes that have been used for walking on the street. If this prohibition is violated, the user will be charged for the additional costs associated with cleaning the sports floor in question.
The user is prohibited from engaging in catering activities.
Pets are not allowed.
Smoking is prohibited throughout the sports facility.
The user is not authorized to make any changes, including advertising, to or in the sports facility without permission from USC.
The user must be in possession of all required permits and exemptions required by the government.

  1. Permission USC prior to use.

The user must obtain prior permission from USC for, among other things, the following activities:

  • Displaying advertisement;
  • The performance of live music;
  • Recording/broadcasting for television or radio purposes;
  • Allowing spectators into the athletic facility;
  • Charging entrance fees;
  • Building stands for exhibitions, markets and the like.
  1. Instructions during use.

USC may at any time give directions regarding the user’s use of the sports hall.
The user shall at all times grant access to the space placed at their disposal to the persons designated for that purpose by USC. The user shall follow all instructions of these persons with regard to the use and furnishing of the space and tolerate that any work deemed necessary by USC can be performed.
The user is obliged to use the space made available to them in such a way that there is no violation of any law, regulation, permit or any other government regulation, including, but not limited to, police and fire department safety standards.

  1. Liability and insurance during use

The user is liable to USC for damage caused during the use of the sports facility by the user themselves or third parties engaged by the user, unless the damage cannot reasonably be attributed to the user. The user hereby agrees to the decision of USC to determine the damage.
If, due to any cause beyond its fault, USC is unable to make the sports hall available to the user, USC shall not be liable for any resulting damages. This applies even if the user has already started using the space. The user indemnifies USC from claims of third parties in this regard.
The user is responsible for the activities that take place in the space made available to them.
USC accepts no liability for damage or loss of user’s materials stored in the sports facility, unless special arrangements have been made in the user agreement.
The user shall ensure adequate insurance of risks and payment of premiums due for this purpose. USC may demand submission of the necessary policies and proofs of payment. If the user fails to meet the obligations in this regard, USC will be released from the obligation to cede the agreed space for use.
If the user’s method of using the sports hall leads to an increase in USC’s insurance premium, this increase shall be borne by the user for the period of one year following the period of use.
USC has the right, in view of a (threatening) calamity or (threatening) irregularities, to have all persons or objects present in the sports facility be removed from the sports facility or not to be admitted to the sports facility. USC is not liable for any costs and damages incurred by the user as a result. The user indemnifies the USC from claims of third parties in this regard.

  1. Other provisions

The USC reserves the right to (temporarily) free the sports hall in the following situations, but not limited to:

  • The taking place of (inter)national/urban (student) sports events in the sports hall in question, as a result of which it cannot be used by third parties;
  • Necessary modifications/work to the sports hall;
  • The public interest;

Should such a situation arise, USC will make every effort to find replacement space for the user. USC will refund to the user any fee already paid to the user.
USC reserves the right to terminate a user agreement in case of violation by the user of provisions mentioned in these general terms and conditions. USC also reserves the right to deny one or more persons access to the sports facility due to misconduct.
The user cannot claim any rights granted to the user by USC in a previous reservation or user agreement.
