{"id":51656,"date":"2022-09-21T11:16:53","date_gmt":"2022-09-21T09:16:53","guid":{"rendered":"https:\/\/www.uscsport.nl\/?page_id=51656"},"modified":"2024-10-01T17:36:04","modified_gmt":"2024-10-01T15:36:04","slug":"terms-and-conditions-concerning-rental","status":"publish","type":"page","link":"https:\/\/www.uscsport.nl\/en\/terms-and-conditions-concerning-rental\/","title":{"rendered":"General rental terms and conditions"},"content":{"rendered":"<p><strong>General terms and conditions for the provision of sport halls by the USC<\/strong><\/p>\n<ol>\n<li>Definitions<\/li>\n<\/ol>\n<p>USC: Trade name of Stichting USC.<br \/>\nUser: The natural or legal person who uses a space in one of the sports facilities of USC and has entered into a user agreement with USC for this purpose.<br \/>\nUser Agreement: The agreement in which the concrete arrangements regarding the use of space by the user in one of USC sports facilities are recorded.<br \/>\nQuotation: The document in which concrete price agreements and hours of use of space(s) in one of USC&#8217;s sports facilities are recorded. A quote accepted by the user is considered by the user and USC as a user agreement.<br \/>\nSports Facility: The accommodation in which the sports hall is located.<br \/>\nDuration of Use: The minimum duration for using a sports hall is 1 hour (with the exception of squash rentals).<br \/>\nSports Hall: A space specified in the quotation, or part thereof, in one of USC\u2019s sports facilities, consisting of one or more sports halls or courts and associated areas, such as locker rooms, showers and toilets.<\/p>\n<ol start=\"2\">\n<li>Realization of user agreement<\/li>\n<\/ol>\n<p>The user can reserve a sports hall with USC\u2019s rental department (\u201cUSC Zaalreservering\u201d). If USC accepts the reservation, USC offers the user a quotation. Once the quotation is confirmed and accepted in writing, it is considered a user agreement.<br \/>\nOnline bookings are also considered user agreements.<br \/>\nThe user agreement is subject to these general terms and conditions as well as the USC house rules.<br \/>\nIf necessary, USC will impose special conditions of use to be specified.<\/p>\n<ol start=\"3\">\n<li>User fee and payment.<\/li>\n<\/ol>\n<p>The user shall pay the user fee due in the manner described in the quotation.<br \/>\nWhere appropriate, USC may charge the user as an advance payment a percentage, to be determined by USC, of the charges set forth in the quotation. If cancellation of the event by the user occurs within the period of 30 work days<br \/>\n(Monday &#8211; Friday) prior to the start of the event, as set forth in Section 5 of these Terms and Conditions, the deposit shall be forfeited to USC.<br \/>\nThe sports halls cannot be put into use by the user until USC is in possession of a by the user accepted quotation.<br \/>\nBy taking into use a hall belonging to a series of reservations, the user accepts the corresponding quotation. USC will then proceed to send the corresponding invoice.<br \/>\nFor one-time use of the hall, the user fee due must be paid prior to the event. The user fee, if applicable, includes VAT.<br \/>\nAmounts of less than \u20ac100,- must be paid at the front desk of the sports facility.<br \/>\nUSC reserves the right to terminate a user agreement if the user does not meet the payment obligation. If, after a payment reminder, the user has not remitted the user fee due within the deadline set in the payment reminder, USC will take collection measures. All costs associated with collection shall be borne entirely by the user.<\/p>\n<ol start=\"4\">\n<li>Services USC<\/li>\n<\/ol>\n<p>USC undertakes to provide a safe and clean sports hall, including the use of sports equipment and locker rooms, sanitary facilities, showers and lockers, music system (if standard in the hall). For events, USC reserves the right to charge additional fees for such things as use of locker rooms, restrooms, materials, etc. These will be disclosed in advance on the quote. Under conditions specified in the user agreement, USC may provide various paid additional services, including: preparing, installing and putting away equipment and materials not included in the usage fee. Staffing before and after the regular opening\/closing time of the sports facility, sports instructors, first aid staff, security.<\/p>\n<ol start=\"5\">\n<li>Cancellation<\/li>\n<\/ol>\n<p>If the user cancels their use of the sports hall or court(s) made available to them on the dates and times mentioned in the offer, the user is obliged to notify USC in writing.<br \/>\nIf, from the date the user agreement is established, until 30 work days before the date in question, the reservation is cancelled, USC will charge 50% of the cost established on the quotation.<br \/>\nIf, within a period of 30 work days prior to the date in question, a reservation is cancelled, USC will charge 100% of the cost established on the quotation.<br \/>\nAdditional cancellation terms may be included in a user agreement.<br \/>\nIn case of cancellation of an online reservation, no refund will be made.<\/p>\n<ol start=\"6\">\n<li>Condition at start of use and after end of use<\/li>\n<\/ol>\n<p>The user must communicate any complaint about the condition of the space they are using to USC immediately upon discovery and confirm, in writing and accompanied by photo evidence, to USC within three working days. If the user fails to do so, the space is deemed to have been in good condition.<br \/>\nThe user shall return the space swept clean after use.<br \/>\nIf the user does not leave the space in good condition, damaged or soiled, USC will perform that in which the user has remained negligent. USC will recover the costs thereof from the user.<\/p>\n<ol start=\"7\">\n<li>Use<\/li>\n<\/ol>\n<p>The user is not entitled to let or sublet the space made available to him to third parties.<br \/>\nThe user undertakes to use the space placed at his disposal only for sports activities or other activities stipulated in the user agreement.<br \/>\nThe hours stipulated in the offer apply to the use of the sports hall(s). The associated changing rooms and showers can be used immediately after, before and after the hours stipulated in the quotation.<br \/>\nThe user cannot enter or be present in the room provided to him outside the hours stipulated in the quotation.<br \/>\nThe preparation of the room by the user must take place within the hours stipulated in the quotation.<br \/>\nThe tidying and cleaning of the sports hall must take place within the hours specified in the quotation.<br \/>\nOnly sports shoes with non-slip soles may be used in a sports hall.<br \/>\nIt is prohibited to play sports on a sports floor with sports shoes that have been used for walking on the street. If this prohibition is violated, the user will be charged for the additional costs associated with cleaning the sports floor in question.<br \/>\nThe user is prohibited from engaging in catering activities.<br \/>\nThe users is prohibited from engaging in (sponsorship) activities that conflict with USC business operations. All sponsorship activities must be coordinated with the USC Zaalreservering department.<br \/>\nPets are not allowed, with the exception of guide dogs.<br \/>\nSmoking is prohibited throughout the sports facility.<br \/>\nThe user is not authorized to make any changes, including advertising, to or in the sports facility without permission from USC.<br \/>\nThe user must be in possession of all required permits and exemptions required by the government.<\/p>\n<ol start=\"8\">\n<li>Permission USC prior to use.<\/li>\n<\/ol>\n<p>The user must obtain prior permission from USC for, among other things, the following activities:<\/p>\n<ul>\n<li>Displaying advertising;<\/li>\n<li>The performance of live music;<\/li>\n<li>Recording\/broadcasting television, radio, or online reports;<\/li>\n<li>Allowing spectators into the sports facilities;<\/li>\n<li>Charging admission fees;<\/li>\n<li>Building stands for exhibitions, markets and the like.<\/li>\n<\/ul>\n<ol start=\"9\">\n<li>Instructions during use.<\/li>\n<\/ol>\n<p>USC may at any time give directions regarding the user&#8217;s use of the sports hall.<br \/>\nThe user shall at all times grant access to the space placed at their disposal to the persons designated for that purpose by USC. The user shall follow all instructions given by these persons with regard to the use and furnishing of the space and shall tolerate any work deemed necessary by USC.<br \/>\nThe user is obliged to use the space made available to them in such a way that there is no violation of any law, regulation, permit or any other government regulation, including, but not limited to, police and fire department safety standards.<\/p>\n<ol start=\"10\">\n<li>Liability and insurance during use<\/li>\n<\/ol>\n<p>The user is liable to USC for damage caused during the use of the sports facility by the user themselves or third party(ies)<br \/>\nengaged by the user, unless the damage cannot reasonably be attributed to the user. The user hereby agrees to the decision of USC to determine the damage.<br \/>\nIf USC, due to any cause beyond its fault, is unable to make the sports hall available to the user, USC shall not be liable for any resulting damages. This applies even if the user has already started using the space. The user indemnifies USC from claims of third parties in this regard.<br \/>\nThe user is responsible for the activities that take place in the space made available to them.<br \/>\nUSC accepts no liability for damage or loss of user&#8217;s materials stored in the sports facility, unless special arrangements are made in the user agreement.<br \/>\nThe user shall ensure adequate insurance of risks and payment of premiums due therefore. USC may demand submission of the necessary policies and proofs of payment. If the user fails to meet the obligations in this regard, USC will be released from the obligation to cede the agreed space for use.<br \/>\nIf the user&#8217;s method of using the sports hall leads to an increase in USC&#8217;s insurance premium, this increase shall be borne by the user for the period of one year following the period of use.<br \/>\nUSC has the right, in view of an (impending) calamity or (impending) irregularities, to have all persons or objects present in the sports facility removed from the sports facility or not admitted to the sports facility. USC is not liable for any costs and damages incurred by the user as a result. The user indemnifies USC from claims of third parties in this regard.<\/p>\n<ol start=\"11\">\n<li>Other provisions<\/li>\n<\/ol>\n<p>USC reserves the right to (temporarily) free up the sports hall in the following situations, among others:<\/p>\n<ul>\n<li>The taking place of (inter)national\/urban (student) sports events in the sports hall in question, as a result of which it cannot<br \/>\nbe used by third parties;<\/li>\n<li>Necessary modifications\/work to the sports hall;<\/li>\n<li>The public interest;<\/li>\n<\/ul>\n<p>Should such a situation arise, USC will make every effort to find a replacement space for the user. USC will refund to the user any fee already paid to the user.<br \/>\nUSC reserves the right to terminate a user agreement in case of violation by the user of provisions mentioned in these General Terms and Conditions.<br \/>\nUSC also reserves the right to deny one or more persons access to the sports facility due to misconduct.<br \/>\nThe user cannot claim any rights granted to the user by USC in a previous reservation period<\/p>\n","protected":false},"excerpt":{"rendered":"General terms and conditions for the provision of sport halls by the USC Definitions USC: Trade name of Stichting USC.
